Welcome to My Doula Dawn. These Terms of Service (“Terms”) govern your use of mydouladawn.com (the “Site”) and the purchase of any products or services offered by My Doula Dawn, owned and operated by Dawn Thompson (“I,” “me,” or “my”).

By accessing or using this Site, purchasing any product, or booking any service, you agree to be bound by these Terms. If you do not agree, please do not use this Site.

1. Acceptance of Terms

By using this Site you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you are purchasing on behalf of someone else you also confirm you have the authority to do so.

2. Products and Services

My Doula Dawn offers the following products and services:

• Digital video products — including the Newborn Sleep Blueprint and future video bundles. Delivered digitally via Gumroad immediately upon purchase.
• Virtual Childbirth Education Course — 6 private one-hour virtual sessions conducted via video call at $300 total.
• Private Consultations — one-on-one virtual sessions at $175 per session.
• Virtual Doula Support — ongoing virtual support packages. Pricing available upon inquiry.
• Birth Planning Sessions — virtual sessions to create and review your birth plan. Starting at $97.

3. Not Medical Advice

All content on this Site and in all products and services — including videos, written materials, consultations, and coaching sessions — is provided for educational and informational purposes only.

• I am a DONA-certified birth and postpartum doula, not a licensed medical professional
• Nothing on this Site or in any product or service constitutes medical advice, diagnosis, or treatment
• Always consult your OB, midwife, pediatrician, or other qualified healthcare provider before making any medical decisions
• In a medical emergency, call 911 or go to your nearest emergency room immediately

By purchasing any product or booking any service, you acknowledge and agree that you understand this distinction and will seek appropriate medical care when needed.

4. Purchases and Payment

All digital product purchases are processed through Gumroad. All consultation and course bookings are scheduled through Calendly and payment is arranged separately. By completing a purchase you agree to:

• Provide accurate and complete payment and contact information
• Pay the full amount due at the time of purchase
• Our Refund Policy which is incorporated into these Terms by reference

All prices are listed in US dollars. We reserve the right to change pricing at any time without notice, though any price change will not affect purchases already completed.

5. Digital Products — License and Use

Upon purchasing a digital product you are granted a personal, non-exclusive, non-transferable license to access and use the content for your own personal, non-commercial use. You agree that you will not:

• Share, resell, redistribute, or give away access to any purchased content
• Copy, reproduce, or duplicate the content in any form
• Use the content for commercial purposes without written permission
• Upload the content to any other platform or sharing service
• Remove any copyright or proprietary notices from the content

All content is protected by copyright law. Unauthorized use may result in legal action.

6. Consultations and Sessions

For virtual consultations, childbirth education sessions, and doula support:

• Sessions are conducted via video call (Zoom or similar platform)
• You are responsible for having a stable internet connection and appropriate device
• Sessions will begin and end at the scheduled time regardless of late arrival
• Please review our Refund Policy for cancellation and rescheduling terms
• Sessions are confidential. I will not share information discussed in sessions without your written consent except as required by law
• Recording of sessions is not permitted without mutual written consent

7. Intellectual Property

All content on this Site including but not limited to text, graphics, logos, images, audio, video, and digital downloads is the property of My Doula Dawn and is protected by United States and international copyright laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or use any content from this Site without my express written permission. The My Doula Dawn name, logo, and branding are proprietary and may not be used without permission.

8. User Conduct

By using this Site you agree not to:

• Use the Site for any unlawful purpose or in violation of any regulations
• Attempt to gain unauthorized access to any part of the Site
• Transmit any harmful, offensive, or disruptive content
• Impersonate any person or entity
• Collect or harvest any personal information from other users
• Use automated tools to access or scrape the Site

9. Third-Party Links and Services

This Site contains links to third-party websites and services including Gumroad, Calendly, MailerLite, and Facebook/Meta. These links are provided for convenience only. I do not control these third-party sites and am not responsible for their content, privacy practices, or terms of service. Your use of third-party sites is at your own risk.

10. Disclaimer of Warranties

This Site and all content, products, and services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. I do not warrant that:

• The Site will be uninterrupted, error-free, or secure
• Any results obtained from using the products or services will meet your specific expectations
• The content is complete, accurate, or up to date

Results from using any product or service will vary based on individual circumstances. Testimonials and examples are not guarantees of results.

11. Limitation of Liability

To the fullest extent permitted by law, My Doula Dawn and Dawn Thompson shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this Site, any product, or any service — including but not limited to loss of profits, data, or goodwill.

Our total liability to you for any claims arising from your use of the Site or purchase of any product or service shall not exceed the amount you paid for the relevant product or service.

12. Indemnification

You agree to indemnify, defend, and hold harmless My Doula Dawn, Dawn Thompson, and any affiliates from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from your use of the Site, violation of these Terms, or violation of any rights of a third party.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be resolved in the courts of San Diego County, California.

14. Dispute Resolution

Before filing any legal claim, you agree to first contact me at dawn@mydouladawn.com to attempt to resolve the dispute informally. I will make every reasonable effort to resolve any issue quickly and fairly.

15. Changes to These Terms

I reserve the right to update these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

16. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and My Doula Dawn regarding your use of the Site and supersede any prior agreements.
